The terms covering use of this site and the referral service, including how Seth's Home Pros is paid and what it is not responsible for.

The agreement here is a referral arrangement rather than a construction contract. Any contract for the work itself is between you and the contractor you hire, and nothing in these terms limits your rights under Maine law.

These terms govern your use of this website and its referral service.

1. Agreeing to These Terms

Using this website means you agree to these terms. The same applies when you submit a form or quiz, or accept a contractor introduction.

If you don't agree, don't use the service.

We may update these terms. The date at the bottom shows when they last changed.

We will post material changes here before they take effect.

2. What the Service Is

Seth's Home Pros connects homeowners in Maine and New Hampshire with residential contractors. We learn about your project and qualify it honestly.

Then we introduce you to contractors we think fit and stay reachable while the project runs.

The referral service costs you nothing.

Seth's Home Pros is not a general contractor. We do not perform, supervise, estimate, permit, schedule, inspect, or guarantee construction work, and we never handle money between you and a contractor. The full list is on our disclaimer page and it is part of these terms.

Any construction contract is between you and the contractor. Seth's Home Pros isn't a party to that contract and does not sign it.

3. Contractor Screening and Its Limits

We screen contractors before admitting them to the network, then review them afterward. This site describes that screening, which we perform in good faith.

Screening reflects what Seth's Home Pros could verify at the time. It does not guarantee a contractor's future performance, financial condition, insurance status, workmanship or conduct on your project.

Maine does not license general contractors or builders. We cannot verify a Maine general contractor license because that license does not exist.

You remain responsible for your own diligence. Check references and confirm current insurance.

Read the contract before signing it.

4. Compensation

Contractors in our network pay Seth's Home Pros a commission when they close work with homeowners we introduced. You pay us nothing for a referral, ever.

We are sometimes paid by real estate professionals too. Depending on the arrangement with a given brokerage, Seth's Home Pros may receive compensation in connection with a realtor referral. It varies by brokerage and it does not apply to every introduction.

We disclose this because we think you should be able to weigh it. Our compensation does not require you to hire anyone.

You may decline any introduction for any reason, or for no reason at all. Ask whether Seth's Home Pros is being paid for your specific referral and we'll tell you straight.

5. Plans and Drafting (The One Thing You Pay Us For)

House plans and design services are sold separately under their own written agreement. These are the only services for which you pay Seth's Home Pros directly.

Conceptual Drawings and Detailed Drawings are drafting and design services. They are not architectural services.

A licensed architect does not prepare, review, stamp or seal them. They are also not engineering services and do not include structural design or calculations.

Architect-Sealed Plans are a separate tier prepared and sealed by a licensed architect.

Our liability for drafting and design work is limited to the amount you paid us for it.

Our permit guarantee is simple. If your code enforcement office rejects the drawings, we revise and resubmit them at no cost to you.

If approval never comes, we refund what you paid. Your municipal code enforcement officer decides whether to approve the permit.

We don't control that decision.

6. Your Responsibilities

  • Give us accurate information about your project, timeline, and budget. Bad inputs produce bad matches.
  • Do your own diligence on any contractor before you sign.
  • Read and understand your contract. Get it in writing.
  • Do not pay Seth's Home Pros for a referral. We do not charge you and we do not collect project funds.

7. Your Rights Under Maine Law

Nothing in these terms waives or limits any right you have under Maine law. Nor do these terms replace those rights, including protections under the Maine Home Construction Contract Act.

If these terms conflict with a right granted by Maine law, Maine law controls.

Worth knowing:

  • Maine caps the initial down payment on a home construction contract at one-third of the contract price.
  • The Maine Attorney General publishes a free model home construction contract. Use it or something at least as thorough.
  • If you are financing, keep disbursements on the agreed draw schedule.

8. Website Content

Cost ranges and timelines on this site are general planning information. Other project information is also for planning only.

None of it constitutes a quote or estimate, nor does it commit anyone to a price or schedule. Every project is different.

Seth's Home Pros owns the content on this site or uses it with permission. Don't republish it as your own.

9. Limitation of Liability

To the fullest extent allowed by Maine law, Seth's Home Pros is not liable for any loss, damage, delay, defect, cost or injury arising from:

  • work performed or not performed by any contractor introduced to you;
  • any contract, dispute, or dealing between you and a contractor;
  • your reliance on general cost or timeline information published on this site.

For a claim related to the referral service, our total liability is limited to the amount you paid Seth's Home Pros. For that service, the amount is zero.

Section 5 states the liability limit for paid design services.

This restriction does not apply to liability that Maine law does not allow us to limit.

10. Privacy

Our privacy policy explains how we handle your information.

11. Governing Law

Maine law governs these terms, without regard to conflict-of-law principles. Any dispute must be brought in a state or federal court located in Maine.
